These Terms of Service ("Terms") govern your access to and use of the Resonate the Word website located at https://www.resonatetheword.com (the "Website"), our mobile applications available on Android and iOS platforms (the "Apps"), and our online store (collectively, the "Services"), operated by Resounding Faith Music, a DBA of SeriousPixel, LLC ("we," "us," "our," or the "Company"). The Services are provided to promote and distribute music and content inspired by Scripture, including digital downloads, streaming, merchandise, and related features.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms apply to all users, including visitors, registered users, and purchasers.

We are based in Tennessee, United States, and these Terms are governed by the laws of the State of Tennessee and applicable federal laws of the United States.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services, you represent and warrant that you meet these eligibility requirements.

2. Changes to the Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on the Website and Apps, with the new effective date. Your continued use of the Services after the posting of changes constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.

3. Description of Services

The Services include:

• Access to music, Scripture-inspired content, blogs, and community features on the Website and Apps.

• An online store for purchasing digital music downloads, physical merchandise (e.g., CDs, apparel), and other products.

• Mobile Apps for streaming music, engaging with content, and making purchases.

• User accounts for personalized experiences, such as saving playlists or tracking orders.

We may add, modify, or discontinue features of the Services at any time without notice.

4. User Accounts

To access certain features, such as making purchases or saving content, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.

• Maintain the security of your account credentials and notify us immediately of any unauthorized access.

• Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms.

5. User Conduct

You agree not to use the Services to:

• Upload, post, or transmit harmful, offensive, or illegal content, including viruses, malware, or spam.

• Interfere with the operation of the Services or other users' enjoyment.

• Engage in commercial activities without our consent, such as unauthorized advertising.

• Reverse engineer, decompile, or attempt to extract source code from the Apps or Services.

• Impersonate any person or entity, or misrepresent your affiliation.

For the Apps, you must comply with the terms of the applicable app store (e.g., Google Play or Apple App Store).

6. Intellectual Property

All content on the Services, including music, lyrics, artwork, text, graphics, logos, and software (collectively, "Content"), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Content for personal, non-commercial purposes. For purchased digital content (e.g., music downloads), you receive a license to download and use it on your devices, but you may not redistribute, sell, or modify it.

You may not copy, reproduce, distribute, or create derivative works from the Content without our express written permission.

If you submit user-generated content (e.g., reviews, comments, or feedback), you grant us a worldwide, royalty-free, perpetual license to use, modify, and display such content in connection with the Services.

7. Purchases and Payments

Ordering and Payment

• All purchases through the online store are subject to product availability.

• Prices are listed in USD and exclude taxes, shipping, and handling fees, which will be added at checkout.

• We accept payments via third-party processors (e.g., Stripe, PayPal). By providing payment information, you authorize us to charge the applicable amount.

• You represent that you are authorized to use the payment method provided.

Digital Products

• Digital downloads (e.g., music files) are delivered electronically upon successful payment. You are responsible for ensuring compatibility with your devices.

Physical Products

• We ship physical merchandise to addresses provided at checkout. Shipping times and costs vary by location and method.

• Title and risk of loss pass to you upon delivery to the carrier.

Taxes

• You are responsible for all applicable sales, use, or value-added taxes.

• We collect and report TN state and local sales tax for all orders placed and shipped within the state.

Order Confirmation and Cancellation

• Orders are confirmed via email. We reserve the right to cancel orders due to pricing errors, unavailability, or suspected fraud.

8. Refunds and Returns

Digital Products

• Due to their nature, digital downloads are non-refundable unless required by law or if there is a technical issue preventing access.

Physical Products

• Returns are accepted within 30 days of receipt for defective or damaged items. Contact support@resonatetheword.com for instructions.

• Refunds will be issued to the original payment method, minus shipping costs.

• Custom or personalized items are non-returnable.

We comply with consumer protection laws, including those for distance selling in applicable jurisdictions.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, available on the Website, which is incorporated herein by reference.

10. Disclaimers

The Services and Content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Music and content on the Services are for inspirational purposes and do not constitute religious, legal, or professional advice.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow limitations on liability, so the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles.

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Tennessee, administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in class actions.

For users in the EU or other jurisdictions requiring it, you may have additional rights to resolve disputes through local courts or consumer protection agencies.

14. Termination

We may terminate or suspend your access to the Services at any time, without notice, for any reason, including breach of these Terms. Upon termination, your licenses and rights under these Terms cease.

15. Miscellaneous

• Severability: If any provision of these Terms is held invalid, the remainder shall continue in full force.

• Waiver: No waiver of any term shall be deemed a further or continuing waiver.

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

• Force Majeure: We shall not be liable for delays caused by events beyond our control, such as natural disasters or pandemics.

• Assignment: We may assign these Terms without your consent; you may not assign without our written consent.
